Trade Dress


Trade dress is the the total image or overall appearance of a product or its packaging.

Like trademarks, trade dress can be protected when it is distinctive. This usually requires acquiring a distinctiveness that provides a secondary meaning of identifying the product, but trade dress can be inherently distinctive in some cases.

The person asserting trade dress protection has the burden of proving that the elements protected are not functional.
