Privileges and Immunities


Rights protected by the Privileges and Immunities Clause if they are "fundamental" to the promotion of interstate harmony.

Four types of rights:

  1. Political rights
    • No right to residents of other states
    • Examples:
      • Vote in primaries
      • Hold officer
  2. Freedom rights
    • Must be provided to residents of other states
    • Examples:
      • Work
      • Own property
      • Access courts
  3. Benefit rights
    • No right to residents of other states if a reason can can be provided
    • Examples:
      • School
      • Welfare
  4. Unimportant rights
    • No right to residents of other states
    • Examples:
      • Deer hunting
