LAW 521-002 – Civil Procedure I

Remedy

A remedy cures a legal harm.

There are three types of remedies:

  1. Substitution Remedies

Substitution remedies are a reasonable substitute, often money, that try to approximate the harm.

  2. Specific Remedies

Specific remedies are court orders for a specific performance, like an injunction or restoring an item.

Specific remedies are equitable remedies that require showing that no adequate remedy at law exists.

  3. Declaratory Remedies

Declaratory remedies declare rights. They do not rule on damages though.
