Hill v. Edmonds

Facts:

Defendant left his truck standing still in the middle of the road with his lights off. Plaintiff was driving down the road and failed to stop for it, colliding with it.

Procedural History:

Trial court dismissed the complaint after a jury trial.

Issue:

Who is liable for an accident where both people are negligent?

Rule/Holding:

Where separate acts of negligence combine to produce directly a single injury each tortfeasor is responsible for the entire result

Judgment:

Complaint reinstated and a new trial ordered.
