Habeas Corpus


Habeas corpus is allowing a person to challenge the reasons for his imprisonment.

Habeas corpus can be suspended only in time of war or insurrection when public safety requires it. This has only happened during the Civil War.

Anyone inside of America has a privilege to petition for a writ of habeas corpus.

People outside the United States generally do not have a privilege to habeas corpus. However, Boumedienne extended the privilege to people outside the country in certain situations.
