Goddard v. Boston & Maine R.R. Co.

Supreme Judicial Court of Massachusetts, 1901

Plaintiff sued defendant for a banana peel on defendant's station that plaintiff fell on. It was about a car's length away from the train.

Procedural History:

Verdict directed for defendant.

Bell: There has to be evidence that the hazard had been on the platform long enough that defendant should have known and removed it.

The banana peel could have been just dropped by a passenger.

Exceptions overruled.
